Samsung to seek injunction against iPhone 4S

Samsung is fighting fire with fire in its patent stoush with Apple, seeking an injunction against sales of the forthcoming iPhone 4S in France and Germany on the basis of patent infringements related to wireless technology.

According to a post on the Samsung blog, the preliminary injunction requests cite two patent infringements for Wideband Code Division Multiple Access (SCDMA) standards for 3G mobile handsets.

"The infringed technology is essential to the reliable functioning of telecom networks and devices,” the blog reads, "and Samsung believes that Apple’s violation as being too severe and that the iPhone 4S should be barred from sales.

"Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.”

Samsung's tablet computer, the Galaxy Tab 10.1, has been barred from sale in Germany and Australia due to claims from Apple the device is too similar to its top-selling iPad.

Samsung plans to file further iPhone 4S injunction requests in other countries.
